Summary
I GATHER there's a new law restricting the height of conifer trees. Can you explain this to me? A conifer hedge divides our house from the one next door, and it comes to within five feet of our front bay windows.
There was a provision to deal with the problems caused by high hedges included in the Anti-Social Behaviour Act which received Royal Assent in November last year. However this particular piece of legislation hasn't actually come into force yet, although it's expected later in the year. It's likely to give local authorities powers to intervene where disputes over tall conifer hedges cannot be resolved amicably. People complaining to the council will have to show that the hedge is more than two metres high, presents a barrier to either light or access, and adversely affects the reasonable enjoyment of their property. Currently you are entitled to cut off branches that protrude on to your property as long as you offer to return the branches to their owner.See the full content of this document
